Have the dvsa gone one step beyond,
are they dvsa Committing Fraud?
The dvsa are proudly announced last year the opening of new theory test sites across the UK to satisfy the demand for more theory tests, supposedly, just to keep up with demand.
But here is the rub as they say.
Q. How long will these certificates last?
A. 2 years is the absolute limit the dvsa told the UK when a petition was raised because so many thousands of candidates had lost out when their certificates expired. This was because the examiners were all sent home due to C19 restrictions and there were no practical tests available and so the certificates expired. ADIs up and down the country appealed for help for their pupils....... dvsa says NO, it is statute and cannot be extended.
Moving on less than 1 year and the dvsa open up a whole flock of theory test centres.
These 20+ new theory test centres will be producing new Pass Certificates to new people who wanted to take the theory test, but, who is going to help these lovely people to go on and get a full licence?
We have a shortage of ADIs (driving instructors) to teach them and take them to test. We have an even bigger shortage of examiners to examine them and hopefully give them their licence. Will the dvsa be employing fairy godmothers with magic wands, or employing Harry Potter and friends to whip up a spell for full licences?
Who is going to be doing these tests, or will the dvsa again say....sorry but your Theory Certificate has expired and you need to take it again....... Is this Fraud I ask?

Fraud Act 2006
(1)A person is in breach of this section if he—
(a)dishonestly makes a false representation, and
(b)intends, by making the representation—
(i)to make a gain for himself or another, or
(repeat exams due to certificate expiring)
(ii)to cause loss to another or to expose another to a risk of loss.
(charged multiple fees for repeat exams)
(2)A representation is false if—
(a)it is untrue or misleading, and
(b)the person making it knows that it is, or might be, untrue or misleading.
(dvsa have all the figures)
(3)"Representation
” means any representation as to fact or law, including a representation as to the state of mind of—
(a)the person making the representation, or(b)any other person.
(4)A representation may be express or implied.....it will be worth the paper it is written on
(this is the icing on the cake)
(5)For the purposes of this section a representation may be regarded as made if it (or anything implying it) is submitted in any form to any system or device designed to receive, convey or respond to communications (with or without human intervention).
So, I ask you, especially if you have a legal qualification in this field, are the dvsa making a false misrepresentation selling the additional appointments for the theory test exam, when it is on record:
1. No chance of the life of the certificate being extended.
2. Many ADIs leaving the profession due to retirement, disillusionment and frustration with the system and mess the booking system for tests is in.
3. No logical hope of a driving test taking place for many thousands of learners due to lack of ADIs to teach them, or examiners to test them and issue the driving test pass certificate for a full licence?
4. The longest driving test waiting lists for decades.
Please let me know if I have got the wrong idea, if the dvsa are completely innocent and have loads of examiners waiting to bounce into action and carry out thousands of extra practical driving test I apologise.
